Veterans In Politics International (VIPI) Demands an Independent Investigation into Possible Felony Crimes Committed by Boulder City Police Chief Thomas Finn

 

 

Boulder City Nevada, Police Chief Thomas Finn wrote an email to his department on June 11, 2012, ordering the entire Boulder City Police Department to destroy public records. This seems to be a felony crime under NRS 239.320.

Las Vegas, Nevada; November 03, 2012, Boulder City Police Chief Thomas Finn is not above the law. It is offensive to learn that Boulder City Police Chief Thomas Finn sent an email to his department on June 11, 2012 (said email is attached to this press release) that identified certain emails as public records and ordered his department to "please delete any and all emails related to the event immediately". Veterans In Politics demands an independent investigation into whether Boulder City Police Chief Thomas Finn committed felony crimes when he ordered his department to delete public records. 

Boulder City Police Chief Thomas Finn is a public officer as defined by NRS 281A.160 and Boulder City Code 2-5-2.

NRS 281A.160 defines a public officer as "a person elected or appointed to a position which: (a) is established by the Constitution of the State of Nevada, a statute of the State or a charter or ordinance of any county, city or other political subdivision; and (b) Involves the exercise of public power, trust or duty." The position of Boulder City police chief is established by Boulder City Code 2-5-2. Therefore, because Boulder City Police Chief Thomas Finn is a person appointed to his position by a city ordinance, and the position involves the exercise of public power, trust and duty, Boulder City Police Chief Thomas Finn is a public officer as defined by NRS 281A.160 and Boulder City Code 2-5-2.

Boulder City Police Chief Likely Committed a Class C Felony by Ordering His Department to Delete Public Records.

NRS 239.320 states: "An officer who mutilates, destroys, conceals, erases, obliterates or falsifies any record or paper appertaining to his or her office, is guilty of a category C felony and shall be punished as provided in NRS 193.130."

On June 11, 2012, Boulder City Police Chief Thomas Finn sent an email to his department. In this email, Boulder City Police Chief Thomas Finn identified certain emails as public records and then ordered his department to "please delete any and all emails related to the event immediately". On its face, Boulder City Police Chief Thomas Finn's June 11, 2012 email seems to violate NRS 239.320. If this is true, Boulder City Police Chief Thomas Finn committed felony crimes and should be held accountable for those crimes. Boulder City Police Chief Thomas Finn is not above the law and should not receive preferential treatment because of his position.

Veterans In Politics demands an independent investigation into whether Boulder City Police Chief Thomas Finn committed felony crimes when he ordered his department to delete public records.

Veterans In Politics calls on the Boulder City Council to make a conflicts referral to the Nevada Attorney General for an independent investigation into whether Boulder City Police Chief Thomas Finn is guilty of these crimes. Boulder City Police Chief Thomas Finn is not above the law and should not receive preferential treatment because of his position.
